The Madras High Court has annulled the order of the State Human Rights Commission, which had dismissed the complaint filed by former minister Jayakumar against the police, and directed the commission to re-investigate the matter.
In connection with the 2022 local body elections, former minister Jayakumar was arrested in a case related to the alleged assault of a DMK functionary. Following his arrest, Jayakumar and his son, Jayavardhan, filed complaints with the State Human Rights Commission, claiming that their human rights were violated during the arrest.
After an inquiry, the State Human Rights Commission, in July 2023, closed the complaints without taking any action against the police.
Challenging this decision, Jayakumar filed a petition in the Madras High Court. The case was heard by Justices S.M. Subramaniam and K. Rajasekar. During the hearing, the judges observed that the commission had erred in closing the complaint without a proper investigation into the allegations against the police.
Subsequently, the High Court quashed the earlier order of the State Human Rights Commission and directed the commission’s chairman to re-investigate Jayakumar’s complaint.
