The Tamil Nadu government has issued a new order to the sub-registrars that they should not refuse to register agricultural lands.
Dinesh Ponraj Oliver, Head of Registration, directed the sub-registrars: “In implementing the amendment to cancel fraudulent deeds, the High Court has issued some directives. Complaints are being made that most of the sub-registrars are acting without proper understanding of this.
Objection: Objection to transfer of property, if any person files a petition, the deed for registration should not be accepted and rejected. In the petition, the supporting documents should be examined for completeness. The injunction petitioner has to see if there is any legal basis to claim and object to the particular property. Bonds should not be rejected in the absence of due satisfaction.
If the value of the property is understated, due inquiry should be conducted and sent for appellate review under Rule 47-A. Apart from that, the bond should not be rejected on the ground that the value quoted is less than the guideline value
Certificate of Sale: Banks auction the loaned assets as per the Credit Act. A sale certificate is issued to the bidder. Registration of such sale certificates shall not be refused. If there is a complaint of refusal to register, strict disciplinary action will be taken against the sub-registrars.
The revenue department should check whether the documents including the title deed for the property to be registered are in order. At the same time, the bond should not be rejected on the ground that the authenticity of the documents should be verified. Check revenue documents such as Patta; Do not disturb the public.
Subdivision: Agricultural land should not be registered as subdivision. However, there is no restriction on buying or selling small area agricultural land as agricultural land. Agricultural lands of small area should not be refused registration on the ground that they are adjacent to the road. District registrars and DIGs should ensure that sub-registrars function properly in these matters,” the order said.
