Madras High Court has ordered to send notice to DMK again on the matter of carrying Gutka inside the assembly.
During the AIADMK regime, DMK MLAs, including the then leader of the opposition and chief minister M. K. Stalin, were ordered to be investigated for carrying the banned Gutka inside the assembly.
Accordingly, the rights committee sent a notice to M.K.Stalin and others. A single judge of the High Court heard the case against the notice and quashed the notice. Against this, the Tamil Nadu Assembly Secretary filed an appeal in the Chennai High Court.
The case is pending before Justice SM Subramaniam and Justice C. Kumarappan. When the case came up for trial, the Tamil Nadu government argued that it would withdraw the case. This was protested by former Deputy Speaker Pollachi Jayaraman. After hearing the arguments of all the parties, the judges adjourned the case till date.
Meanwhile, the case came up for hearing today before Justice Subramanian. The judge said that it has been said that even the then Chief Minister M.K.Stal did not receive the notice. And why not send notice even to important persons including M.G.Stalin? He questioned.
The lawyer appearing for the government said that only 4 people have been given notice; He said that they failed to send notice in the previous regime. As the notice was not received, the judge ordered to send a notice to the then DMK MLAs who were included as respondents and adjourned the case till 28th.
