‘Welfare’ case against the Central Government … Delhi Government’s petition rejected…

The Delhi government has filed a public interest litigation against a notification issued by the Union Environment Ministry regarding the setting up of a thermal power plant. According to the petition, 10 thermal power plants in Punjab, Haryana and Uttar Pradesh did not follow the high pollution emission technology (FGD). This is causing environmental damage.
The judges who considered the petition said:
Public interest litigation is filed on behalf of individuals or organizations. Such cases will be filed on behalf of the public and people who cannot sue in court and justice will be made available to those involved.
If the Central Government acts contrary, it is up to the concerned State Government (Delhi) to file a case against it. It is strange and surprising that a welfare case has been filed against the Central Government instead. This cannot be accepted.
The petition was thus dismissed.
Senior Advocate Colin Consolves told the judges that the petition would be withdrawn.
